Community Construction Projects in the UK

In circumstances where the CDM Regulations apply there is a risk factor for every duty holder.  The client, all designers and contractors as well as individual workers have unavoidable legal duties under the CDM Regulations (2015).

One of hardest duties to comply with might seem to be the requirement to verify the competency of workers before they are engaged for work on site. To fail to do this is actually a criminal offence with possible heavy penalties attached.

Workers are also committing an offence if they offer themselves for work for which they are not competent.

The requirement for a CDM Coordinator (2007 regs.) no longer applies, but a Principal Designer (to control the pre-construction phase) and a Principal Contractor (in charge of the construction phase) must be appointed if it is reasonably foreseeable that more than one contractor will be employed on the project.

These appointments must be made as soon as possible, but in any event before the construction phase begins.
